Terms of Service

1. Acceptance of Terms

By accessing and using the TranscriMed API ("Service"), you ("Partner", "Developer") agree to be bound by these Terms of Service. If you are using our Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Service Description

TranscriMed provides an API platform enabling integration between healthcare information systems (RIS/PACS) and our medical documentation service. The Service includes:

• OAuth 2.0 authentication and authorization framework
• Worklist API for bidirectional exam data exchange
• Medical document generation and delivery services
• Real-time status updates and webhooks
• Developer dashboard for monitoring and management

3. OAuth 2.0 Authorization

Partners must implement OAuth 2.0 authorization code flow to access our API. This requires:

• Obtaining explicit consent from TranscriMed doctors for data access
• Requesting only necessary scopes for your integration
• Securely storing client credentials and access tokens
• Refreshing tokens according to our security policies
• Never sharing authentication credentials with third parties

4. Data Protection and Privacy

All parties must comply with applicable data protection laws including:

Partners agree to:

• Process medical data only for authorized purposes
• Implement appropriate technical and organizational security measures
• Report incidents to the controller without unjustified delay
• Maintain audit logs of all data access
• Delete data upon termination of authorization

5. API Usage Guidelines

5.1 Rate Limits

• Standard tier: 1,000 requests per hour
• Enterprise tier: Custom limits based on agreement
• Webhook delivery: Maximum 3 retry attempts

5.2 Acceptable Use

You agree NOT to:

• Attempt to gain unauthorized access to systems or data
• Interfere with or disrupt the Service
• Use the API for any illegal or unauthorized purpose
• Resell or sublicense API access without permission
• Remove or alter any proprietary notices

6. Medical Data Handling

When handling medical data through our API, Partners must:

• Ensure only authorized healthcare professionals access patient data
• Maintain data integrity and accuracy
• Use encryption for data in transit (TLS 1.2 or higher)
• Implement access controls and authentication
• Comply with medical record retention requirements

7. Intellectual Property

TranscriMed retains all rights to the Service, API, documentation, and related materials. Partners retain rights to their own applications and data, granting TranscriMed only the necessary license to provide the Service.

8. Service Level Agreement

• Target uptime: 99.5% monthly availability
• Planned maintenance: Notified 48 hours in advance
• Support response time: 24 hours for critical issues
• API versioning: 6 months notice for breaking changes

9. Liability and Indemnification

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TranscriMed shall not be liable for any indirect, incidental, special, or consequential damages. Each party agrees to indemnify the other against claims arising from their breach of these terms.

10. Termination

Either party may terminate this agreement with 30 days notice. TranscriMed may immediately suspend access for:

• Violation of these terms
• Security concerns or suspected unauthorized access
• Non-payment (for paid tiers)
• Legal or regulatory requirements

11. Modifications to Terms

TranscriMed reserves the right to modify these terms with 30 days notice via email and developer portal announcement. Continued use after modifications constitutes acceptance of updated terms.

12. Governing Law

These terms are governed by the laws of Brazil. Any disputes shall be resolved in the courts of São Paulo, SP, Brazil.
